✧ The inheritance of the Magian

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي مَجُوسِيٍّ تَزَوَّجَ أُخْتَهُ، فَوَلَدَتْ لَهُ بِنْتًا، ثُمَّ أَسْلَمُوا، ثُمَّ مَاتَ - قَالَ: " بِنْتُهُ تَرِثُ النِّصْفَ، وَالنِّصْفُ لِأُخْتِهِ؛ لِأَنَّهَا عَصَبَةٌ ". وَقَالَ فِي مَجُوسِيٍّ تَزَوَّجَ أُمَّهُ، فَوَلَدَتْ لَهُ بِنْتَيْنِ، ثُمَّ أَسْلَمُوا فَمَاتَ الرَّجُلُ: " فَلِابْنَتَيْهِ الثُّلُثَانِ، وَلِأُمِّهِ السُّدُسُ. ثُمَّ مَاتَتْ إِحْدَى الْبِنْتَيْنِ، تَرِثُ أُخْتُهَا النِّصْفَ، وَالْأُمُّ صَارَتْ أُمًّا وَجَدَّةً، فَحَجَبَتْهَا نَفْسُهَا فَوَرَّثْنَاهَا مِيرَاثَ الْأُمِّ، وَلَمْ نُعْطِهَا مِيرَاثَ الْجَدَّةِ ". وَيَقُولُ: " إِنَّ الْأُمَّ حِينَ أَسْلَمُوا انْفَسَخَ لَهُ النِّكَاحُ، فَلَا يَنْبَغِي لَهُ أَنْ يُقِيمَ بَعْدَ الْإِسْلَامِ عَلَى أُمِّهِ، وَلَا أُخْتِهِ؛ وَرَّثْنَاهُ بِالْقَرَابَةِ
Translation
✧ Regarding a Magian who marries his sister, and she bears him a daughter, then they embrace Islam, and then he dies—he said: "His daughter inherits half, and half goes to his sister, because she is an 'asaba." And he said regarding a Magian who marries his mother, and she bears him two daughters, then they embrace Islam, and the man dies: "His two daughters receive two-thirds, and his mother receives one-sixth. Then one of the daughters dies; her sister inherits half, and the mother became both mother and grandmother, so she excludes herself, and we give her the inheritance of a mother, and we do not give her the inheritance of a grandmother." And he says: "When they embraced Islam, the marriage was dissolved for him, so it is not appropriate for him to remain married to his mother or his sister after Islam; we give him inheritance on the basis of kinship."
