✧ The inheritance of the Magian

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ: قُلْتُ أَنَا وَمُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى:
إِنْ تَزَوَّجَ مَجُوسِيٌّ ابْنَتَهُ فَوَلَدَتْ لَهُ ابْنَتَيْنِ، فَمَاتَ، ثُمَّ أَسْلَمْنَ، فَمَاتَتْ إِحْدَى ابْنَتَيْهِ - فَلِأُخْتِهَا لِأَبِيهَا وَأُمِّهَا الشَّطْرُ، وَلِأُمِّهَا السُّدُسُ، حَجَبَتْهَا نَفْسُهَا مِنْ أَجْلِ أَنَّهَا أُخْتُ ابْنَتِهَا، وَحَجَبَتْهَا ابْنَتُهَا الْبَاقِيَةُ أُخْتُ ابْنَتِهَا، ثُمَّ لِلْأُمِّ أَيْضًا مَا لِلْأُخْتِ مِنَ الْأَبِ ". وَقَالَ الثَّوْرِيُّ مِثْلَ قَوْلِهِمَا: لِأُخْتِهَا مِنْ أَبِيهَا وَأُمِّهَا النِّصْفُ، وَلِلْأُخْتِ مِنَ الْأَبِ السُّدُسُ تَكْمِلَةً لِلثُّلُثَيْنِ أَيْضًا، وَلَهَا أَيْضًا السُّدُسُ؛ لِأَنَّهَا أُمٌّ حَجَبَتْ نَفْسَهَا؛ وَلِأَنَّهَا أُخْتٌ فَصَارَ لَهَا الثُّلُثُ ". قَالَ الثَّوْرِيُّ: وَهَذَا قَوْلُ إِبْرَاهِيمَ: " يَرِثُونَ مِنْ مَكَانَيْنِ
Translation
✧ If a Magian marries his daughter and she bears him two daughters, then he dies, and then they embrace Islam, and one of his daughters dies—her full sister receives half, and her mother receives one-sixth; she is excluded by herself because she is the sister of her daughter, and her remaining daughter, who is her daughter's sister, also excludes her. Then the mother also receives what the paternal sister would receive." And al-Thawri said something similar to their statement: "Her full sister receives half, and the paternal sister receives one-sixth to complete the two-thirds, and she also receives one-sixth because she is the mother who excludes herself; and because she is a sister, she receives one-third." Al-Thawri said: "This is the statement of Ibrahim: 'They inherit from two capacities.'"
