✧ A Muslim dies leaving a Christian child

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ: قَالَ لِي عَطَاءٌ:

إِنْ مَاتَ مُسْلِمٌ وَلَهُ وَلَدٌ نَصْرَانِيٌّ، فَلَمْ يُقْسَمْ مِيرَاثُهُ حَتَّى أَسْلَمَ وَلَدُهُ النَّصْرَانِيُّ - فَلَا حَقَّ لَهُ، وَقَعَ الْمِيرَاثُ قَبْلَ أَنْ يُسْلِمَ، مِثْلُ ذَلِكَ فِي الْعَبْدِ مَاتَ أَبُوهُ حُرًّا، فَلَا يُقْسَمُ مِيرَاثُهُ حَتَّى يَعْتِقَ

Translation

✧ If a Muslim dies leaving a Christian child, his inheritance is not divided until his Christian child embraces Islam – then he has no right; the inheritance took effect before he embraced Islam. The same applies to a slave whose father died free: his inheritance is not divided until he is freed.
