✧ Spoils and Fay' Are Different

عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
الْفَيْءُ وَالْغَنِيمَةُ مُخْتَلِفَانِ، أَمَّا الْغَنِيمَةُ: فَمَا أَخَذَ الْمُسْلِمُونَ فَصَارَ فِي أَيْدِيهِمْ مِنَ الْكُفَّارِ، وَالْخُمُسُ فِي ذَلِكَ إِلَى الْأَمِيرِ يَضَعُهُ حَيْثُمَا أَمَرَ اللهُ، وَالْأَرْبَعَةُ الْأَخْمَاسِ الْبَاقِيَةُ لِلَّذِينَ غَنِمُوا الْغَنِيمَةَ، وَالْفَيْءُ: مَا وَقَعَ مِنْ صُلْحٍ بَيْنَ الْإِمَامِ وَالْكُفَّارِ فِي أَعْنَاقِهِمْ، وَأَرْضِهِمْ، وَزَرْعِهِمْ، وَفِيمَا صُولِحُوا عَلَيْهِ مِمَّا لَمْ يَأْخُذْهُ الْمُسْلِمُونَ عَنْوَةً، وَلَمْ يَحُوزُوهُ، وَلَمْ يَقْهَرُوهُ عَلَيْهِ، حَتَّى وَقَعَ فِيهِ بَيْنَهُمْ صُلْحٌ " قَالَ: " فَذَلِكَ الصُّلْحُ إِلَى الْإِمَامِ، يَضَعُهُ حَيْثُ أَمَرَ اللهُ
Translation
✧ Fay' and ghanimah are different. As for ghanimah: it is what the Muslims took and came into their hands from the disbelievers; the fifth of that goes to the commander, and he places it wherever Allah has commanded. The remaining four-fifths belong to those who gained the spoils. As for fay': it is what resulted from a peace treaty between the imam and the disbelievers regarding their persons, their land, their crops, and what they agreed upon from what the Muslims did not take by force, nor did they seize it, nor did they overpower it, until a peace treaty occurred between them regarding it. That peace treaty belongs to the imam, and he places it wherever Allah has commanded.
