عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ قَيْسِ بْنِ مُسْلِمٍ الْجَدَلِيِّ قَالَ:
سَأَلْتُ الْحَسَنَ بْنَ مُحَمَّدِ بْنِ عَلِيِّ بْنِ الْحَنَفِيَّةِ عَنْ قَوْلِ اللهِ تَعَالَى: ﴿وَاعْلَمُوا أَنَّمَا غَنِمْتُمْ مِنْ شَيْءٍ فَأَنَّ لِلهِ خُمُسَهُ ﴾قَالَ: " هَذَا مِفْتَاحُ كَلَامٍ، لِلهِ الدُّنْيَا وَالْآخِرَةُ، وَلِلرَّسُولِ، وَلِذِي الْقُرْبَى فَاخْتَلَفُوا بَعْدَ وَفَاةِ رَسُولِ اللهِ ﷺ فِي هَذَيْنِ السَّهْمَيْنِ، قَالَ قَائِلٌ: سَهْمُ ذِي الْقُرْبَى لِقَرَابَةِ النَّبِيِّ ﷺ، وَقَالَ قَائِلٌ: سَهْمُ ذِي الْقُرْبَى لِقَرَابَةِ الْخَلِيفَةِ، وَاجْتَمَعَ رَأْيُ أَصْحَابِ مُحَمَّدٍ ﷺ أَنْ يَجْعَلُوا هَذَيْنِ السَّهْمَيْنِ فِي الْخَيْلِ وَالْعُدَّةِ فِي سَبِيلِ اللهِ، وَكَانَ ذَلِكَ فِي خِلَافَةِ أَبِي بَكْرٍ وَعُمَرَ، قُلْتُ لَهُ:.... قَالَ: " إِنَّهُ كَانَ يَكْرَهُ أَنْ يُدَّعَى عَلَيْهِ خِلَافُهُمَا ".
Translation
✧ I asked al-Hasan b. Muhammad b. 'Ali b. al-Hanafiyyah about the saying of Allah, Exalted is He: 'And know that of anything you gain as spoils, a fifth is for Allah.' He said: 'This is the opening phrase of the statement. To Allah belong this world and the Hereafter, and to the Messenger, and to the near relatives. After the death of the Messenger of Allah ﷺ they differed concerning these two shares. One party said: "The share of the near relatives belongs to the relatives of the Prophet ﷺ." Another party said: "The share of the near relatives belongs to the relatives of the caliph." The companions of Muhammad ﷺ agreed unanimously to allocate these two shares for horses and equipment in the cause of Allah, and that was during the caliphate of Abu Bakr and 'Umar.' I said to him: '...' He said: 'He disliked that it be claimed he opposed the two.'
