عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
قُلْتُ لِعَطَاءٍ: نِسَاءٌ حَرَائِرُ أَصَابَهُنَّ الْعَدُوُّ فَابْتَاعَهُنَّ رَجُلٌ، أَيُصِيبُهُنَّ ؟ قَالَ: " وَلَا يَسْتَرِقُّهُنَّ وَلَكِنْ يُعْطِيهِنَّ أَنْفُسَهُنَّ بِالَّذِي أَخَذَهُ بِهِ، لَا يُزَادُ عَلَيْهِنَّ " قَالَ: وَقَالَ فِي ذَلِكَ عَبْدُ الْكَرِيمِ: " إِنْ كَانَتْ مِنْ أَهْلِ الذِّمَّةِ فَكَذَلِكَ أَيْضًا
Translation
✧ I said to 'Ata': 'Free women whom the enemy captured and a man purchased them—may he have intercourse with them?' He said: 'He must not enslave them, but he may free them in exchange for what he paid for them, without increasing anything over them.' He said: 'Abd al-Karim said the same about this: if they are from the people of the covenant, it is also like that.'
