✧ Property taken by the enemy then found by its owner

عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ قَالَ:

إِذَا أَصَابَ الْعَدُوُّ شَيْئًا مِنْ مَتَاعِ الْمُسْلِمِينَ فَهُوَ لِصَاحِبِهِ مَا لَمْ يُقْسَمْ، فَإِنِ اقْتَسَمُوهُ فَصَاحِبُهُ أَحَقُّ بِثَمَنِهِ

Translation

✧ When the enemy seizes any of the Muslims' property, it belongs to its owner as long as it has not been divided. If they divide it, its owner is more entitled to its price.
