✧ Property taken by the enemy then found by its owner

عَبْدُ الرَّزَّاقِ، عَنْ مُحَمَّدِ بْنِ رَاشِدٍ قَالَ: حَدَّثَنَا مَكْحُولٌ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَالَ:

مَا أَصَابَ الْمُشْرِكُونَ مِنْ مَالِ الْمُسْلِمِينَ، ثُمَّ أَصَابَهُ الْمُسْلِمُونَ بَعْدُ، فَإِنْ أَصَابَهُ صَاحِبُهُ قَبْلَ أَنْ تَجْرِيَ عَلَيْهِ سِهَامُ الْمُسْلِمِينَ فَهُوَ أَحَقُّ بِهِ، وَإِنْ جَرَتْ عَلَيْهِ سِهَامُ الْمُسْلِمِينَ، فَلَا سَبِيلَ إِلَيْهِ إِلَّا بِالْقِيمَةِ

Translation

✧ Whatever the polytheists take from the property of the Muslims, and then the Muslims later capture it: if its owner finds it before the shares of the Muslims are allotted for it, he has a greater right to it. If the shares of the Muslims have been allotted for it, there is no way for him to it except by paying its value.
