عَبْدُ الرَّزَّاقِ، قَالَ: سَمِعْتُ هِشَامًا يُحَدِّثُ عَنْ مُحَمَّدٍ:

أَنَّ رَجُلَيْنِ احْتَكَمَا إِلَى شُرَيْحٍ فِي أَمَةٍ سُبِيَتْ مِنَ الْمُسْلِمِينَ، ثُمَّ اشْتَرَاهَا رَجُلٌ مِنَ الْعَدُوِّ، فَقَالَ شُرَيْحٌ: " أَحَقُّ مَنْ رَدَّ عَلَى الْمُسْلِمِ أَخُوهُ " قَالَ الْآخَرُ: إِنَّهَا قَدْ حَبِلَتْ مِنِّي فَقَالَ شُرَيْحٌ: " أَعْتِقْهَا، قَضَاءُ الْأَمِيرِ " يَعْنِي عُمَرَ بْنَ الْخَطَّابِ

Translation

✧ Two men brought a dispute before Shurayh concerning a female slave who had been taken captive from the Muslims, and then a man had bought her from the enemy. Shurayh said, "The most entitled to return it to the Muslim is his brother." The other said, "She has become pregnant from me." Shurayh said, "Set her free; it is the ruling of the Commander—meaning Umar b. al-Khattab."
