عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ تَمِيمِ بْنِ طَرَفَةَ:
أَنَّ الْعَدُوَّ أَصَابُوا نَاقَةَ رَجُلٍ مِنَ الْمُسْلِمِينَ، فَاشْتَرَاهَا رَجُلٌ مِنَ الْمُسْلِمِينَ مِنَ الْعَدُوِّ فَعَرَفَهَا صَاحِبُهَا، وَأَقَامَ عَلَيْهَا الْبَيِّنَةَ، فَاخْتَصَمَا إِلَى النَّبِيِّ ﷺ، فَقَضَى النَّبِيُّ ﷺ أَنْ يَدْفَعَ إِلَيْهِ الثَّمَنَ الَّذِي اشْتَرَاهَا بِهِ مِنَ الْعَدُوِّ، وَإِلَّا خَلَّى بَيْنَهَا وَبَيْنَ الْمُشْتَرِي
Translation
✧ The enemy captured the she-camel of a Muslim man, and a Muslim man bought it from the enemy. Its owner recognized it and established clear proof for it. They brought their dispute to the Prophet ﷺ, and the Prophet ﷺ ruled that he should pay to the buyer the price he had paid for it to the enemy; otherwise, he should leave it to the buyer.
