✧ Property taken by the enemy then found by its owner

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:

قُلْتُ لِعَطَاءٍ: الْمَتَاعُ يُصِيبُهُ الْعَدُوُّ مِنَ الْمُسْلِمِينَ، ثُمَّ يُفِيئُهُ اللهُ عَلَيْهِمْ ؟ قَالَ: " إِنْ لَمْ يَكُنْ مَضَتْ فِيهِ سُنَّةٌ رُدَّ إِلَيْهِ أَحَبُّ مَا لَمْ يُقْسَمْ فَإِنْ قُسِمَ فَلَا شَيْءَ لَهُ

Translation

✧ I said to ʿAṭāʾ: Property that the enemy takes from the Muslims, then God restores it to them? He said: "If no precedent has been established regarding it, returning it to him is preferable, as long as it has not been divided. If it has been divided, then he has no right to it."
