✧ Game, slaughtering it, and lying in wait for it

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ
كَرِهَ أَنْ يُرْسِلَ الرَّجُلُ كِلَابَهُ وَهُوَ فِي الْحَرَمِ عَلَى صَيْدٍ فِي الْحِلِّ، فَإِنْ فَعَلَ فَقَتَلْنَ فَعَلَيْهِ غُرْمُهُ وَافِيًا "، قَالَ عَطَاءٌ: " وَإِنْ سَرَّحْتَ كِلَابَكَ فِي الْحِلِّ فَقَتَلْنَ فِي الْحَرَمِ فَلَا غُرْمَ عَلَيْكَ، وَلَا تَأْكُلْهُ "، فَقُلْتُ لَهُ: فَأَخَذْتُهُ فِي الْحِلِّ ثُمَّ دَخَلْتُ فِي الْحَرَمِ فَأَدْرَكْتُهُ حَيًّا ؟ قَالَ: " دَعْهُ لَيْسَ لَكَ "، قَالَ: قَتَلْتُهُ فِي الْحَرَمِ ؟ قَالَ: " لَيْسَ لَكَ لَا تَأْكُلْهُ أَيْضًا
Translation
✧ He disliked a man sending his dogs while he is inside the Sacred Precincts after game that is outside the Sacred Precincts. If he does so and they kill it, he must pay full compensation for it. 'Ata' said: 'If you send your dogs in the outside area and they kill in the Sacred Precincts, no compensation is due from you, but do not eat it.' I said to him: 'What if I caught it outside the Sacred Precincts, then I entered the Sacred Precincts and found it alive?' He said: 'Leave it; it is not yours.' He said: 'What if I killed it in the Sacred Precincts?' He said: 'It is not yours; do not eat it either.'
