عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ عُيَيْنَةَ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ، عَنْ قَبِيصَةَ بْنِ جَابِرٍ الْأَسَدِيِّ قَالَ:
خَرَجْنَا حُجَّاجًا، فَإِنَّا لَنَسِيرُ إِذْ كَثُرَ مِرَاءُ الْقَوْمِ أَيُّهُمَا أَسْرَعُ سَعْيًا الظَّبْيُ أَمِ الْفَرَسُ ؟ إِذْ سَنَحَ لَنَا ظَبْيٌ، وَالسُّنُوحُ هَكَذَا، وَأَشَارَ مِنْ قِبَلِ الْيَسَارِ إِلَى الْيَمِينِ، فَرَمَاهُ رَجُلٌ مِنَّا فَمَا أَخْطَأَ خُشَشَاءَهُ، فَرَكِبَ رَدْعَهُ، فَسَقَطَ فِي يَدِهِ حَتَّى قَدِمَا عَلَى عُمَرَ فَأَتَيْنَاهُ، وَهُوَ بِمِنًى، فَجَلَسْتُ بَيْنَ يَدَيْهِ أَنَا وَهُوَ فَأَخْبَرَهُ الْخَبَرَ، فَقَالَ: " كَيْفَ أَصَبْتَهُ أَخَطَأً أَمْ عَمْدًا ؟ " قَالَ سُفْيَانُ: قَالَ مِسْعَرٌ: لَقَدْ تَعَمَّدْتُ رَمْيَهُ، وَمَا تَعَمَّدْتُ قَتْلَهُ قَالَ: وَحَفِظْتُ أَنَّهُ قَالَ: فَاخْتَلَطَ الرَّجُلُ، فَقَالَ: مَا أَصَبْتُهُ خَطَأً، وَلَا عَمْدًا، فَقَالَ مِسْعَرٌ: فَقَالَ لَهُ: لَقَدْ شَارَكْتَ الْعَمْدَ وَالْخَطَأَ قَالَ: فَاجْتَنَحَ إِلَى رَجُلٍ، وَاللهِ لَكَأَنَّ وَجْهَهُ قُلْبٌ فَسَاوَرَهُ، ثُمَّ أَقْبَلَ عَلَيْنَا، فَقَالَ: خُذْ شَاةً فَأَهْرِقْ دَمَهَا، وَتَصَدَّقْ بِلَحْمِهَا، وَاسْقِ إِهَابَهَا سِقَاءً، قَالَ: فَقُمْنَا مِنْ عِنْدِهِ فَقُلْتُ: أَيُّهَا الْمُسْتَفْتِي ابْنَ الْخَطَّابِّ إِنَّ فُتْيَاهُ لَنْ يُغْنِيَ عَنْكَ مِنَ اللهِ شَيْئًا، فَانْحَرْ نَاقَتَكَ، وَعَظِّمْ شَعَائِرَ اللهِ، وَاللهِ مَا عَلِمَ عُمَرُ حَتَّى سَأَلَ الرَّجُلَ إِلَى جَنْبِهِ، فَانْطَلَقَ ذُو الْعَيْنَيْنِ فَنَمَّاهَا إِلَى عُمَرَ فَوَاللهِ مَا شَعَرْتُ إِلَّا وَهُوَ مُقْبِلٌ عَلَى صَاحِبِي بِالدِّرَّةِ صُفُوقًا، ثُمَّ قَالَ: " قَاتَلَكَ اللهُ أَتَعَدَّى الْفُتْيَا، وَتَقْتُلُ الْحَرَامَ ؟ "، قَالَ: ثُمَّ أَقْبَلَ إِلَيَّ فَقُلْتُ: يَا أَمِيرَ الْمُؤْمِنِينَ لَا أُحِلُّ لَكَ شَيْئًا حَرَّمَهُ اللهُ عَلَيْكَ قَالَ: فَأَخَذَ بِمَجَامِعِ ثِيَابِي فَقَالَ: " إِنِّي أَرَاكَ إِنْسَانًا فَصِيحَ اللِّسَانِ فَسِيحَ الصَّدْرِ، وَقَدْ يَكُونُ فِي الرَّجُلِ عَشَرَةُ أَخْلَاقٍ، تِسْعَةٌ صَالِحَةٌ، وَوَاحِدَةٌ سَيِّئَةٌ فَيُفْسِدُ التِّسْعَةَ الصَّالِحَةَ الْخُلُقُ السَّيِّئُ، اتَّقِ طَيْرَاتِ الشَّبَابِ " أَوْ قَالَ: " غَرَّاتِ الشَّبَابِ
Translation
✧ We set out as pilgrims, and while we were traveling, the people argued a lot about which is faster in running, the antelope or the horse. Then an antelope appeared to us, and the sunuh is like this—and he gestured from left to right—and a man among us shot it and did not miss its khushasha', so it collapsed in its blood, and he was at a loss until we came to Umar. We came to him while he was at Mina, and I sat before him with him, and he told him the news. He said: "How did you hit it, by mistake or intentionally?" Sufyan said: Mis'ar said: "I deliberately aimed at it, but I did not intend to kill it." He said: And I remember that he said: The man became confused and said: "I did not hit it by mistake or intentionally." So Mis'ar said: He said to him: "You have combined intention and mistake." So he leaned toward a man, and by God, his face was like a heart, and consulted him, then turned to us and said: "Take a sheep, shed its blood, give its meat as charity, and use its hide as a waterskin." So we got up from his presence, and I said: "O seeker of fatwa from Ibn al-Khattab, his fatwa will not avail you anything before God. So sacrifice your camel and exalt the rituals of God. By God, Umar did not know until he asked the man beside him." The man with the two eyes went and reported it to Umar. By God, I was only aware when he came at my companion with the whip, striking him, then said: "May God fight you, do you transgress in the fatwa and kill the sacred game?" Then he turned to me, and I said: "O Commander of the Believers, I will not make lawful for you what God has made forbidden to you." So he took hold of my clothes at the chest and said: "I see you are a man eloquent of tongue and broad of heart, and a man may have ten traits, nine good and one bad, and the bad trait corrupts the nine good ones. Beware of the flights of youth," or he said: "the deceptions of youth."
