✧ The man who comes for the night prayer and has not prayed the Isha

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ قَالَ:
إِنْ أَلْفَاكَ الْقَارِئُ تُصَلِّي الْعِشَاءَ الْآخِرَةَ فِي رَمَضَانَ، قَدْ كَبَّرْتَ قَبْلَهُ، فَاجْعَلْ صَلَاتَكَ الْعِشَاءَ صَلِّهَا بِصَلَاتِهِ إِنْ كَانَ يُتِمُّهَا، وَإِلَّا فَخَالِفْهُ، وَلَا تُصَلِّ بِصَلَاتِهِ "، فَقُلْتُ: كَبَّرَ قَبْلِي وَأَنَا أُرِيدُ أَنْ أُصَلِّيَ الْعِشَاءَ ؟ قَالَ: " فَكَبِّرْ، وَاجْعَلْهَا الْعِشَاءَ إِنْ كَانَ يُتِمُّهَا، وَإِلَّا فَاجْعَلْهَا سُبْحَةً، ثُمَّ صَلِّ الْعِشَاءَ بَعْدُ
Translation
✧ If the reciter finds you praying the last Isha in Ramadan and you had said the takbir before him, make your prayer the Isha—pray it with his prayer if he completes it; otherwise, differ from him and do not pray with his prayer.' I said: 'He said the takbir before me while I want to pray Isha?' He said: 'Then say the takbir and make it Isha if he completes it; otherwise, make it a voluntary prayer, then pray Isha afterward.'
