✧ Give Its Due on the Day of Its Harvest

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُ لِعَطَاءٍ:
أَرَأَيْتَ إِنِ ابْتَاعَ إِنْسَانٌ مِنْ إِنْسَانٍ ثَمَرَ حَائِطِهِ، مَا كَانَتْ فَحَصَدَ، أَيُّهُمَا يُؤَدِّي حَقَّ مَا حَصَدَ: الْبَائِعُ أَوِ الْمُبْتَاعُ ؟ قَالَ: " الْمُبْتَاعُ، قَالَهُ غَيْرَ مَرَّةٍ رَاجَعْتُهُ فِي الصَّدَقَةِ عَلَى أَيِّهِمَا هُوَ ؟ "، قَالَ: عَلَى الْمُبْتَاعِ إِنْ لَمْ يَكُونَا ذَكَرَاهَا، قَالَهُ غَيْرَ مَرَّةٍ، قُلْتُ لَهُ: مِنْ أَيْنَ يُؤْخَذُ هَذَا ؟ قَالَ: " هُوَ حَائِطٌ فِيهِ صَدَقَةٌ ابْتَاعَهُ، وَيَرَى فِيهِ عَلَيْهِ الصَّدَقَةَ إِلَّا أَنْ يَكُونَ شَرَطَ أَنَّهَا لَيْسَتْ عَلَيْهِ، وَقَدْ كَانَ قَالَ لِي بَعْدَ ذَلِكَ: إِنْ كَانَ يَدَعُ الْحَائِطَ كُلَّهُ فَعَلَى سَيِّدِهِ الصَّدَقَةُ
Translation
✧ Have you considered if a person buys from another the fruit of his garden, whatever it was, and then harvests it: which of them pays the due of what was harvested, the seller or the buyer? He said: “The buyer.” He said this more than once. I came back to him about the charity, upon which of them it is. He said: “Upon the buyer, if they did not mention it.” He said this more than once. I said to him: “From where is this taken?” He said: “It is a garden with charity due in it that he bought, and he considers that the charity is upon him, unless he stipulated that it is not upon him.” He had said to me after that: “If he leaves the entire garden, then the charity is upon its owner.”
