عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُ لِعَطَاءٍ:
أَرَأَيْتَ الْمَالَ يَكُونُ عَلَى الْعَيْنِ عَامَّةَ الزَّمَانِ، ثُمَّ يَحْتَاجُ إِلَى الْبِئْرِ فَيُسْقَى بِهَا، ثُمَّ يَصِيرُ إِلَى الْعَيْنِ، كَيْفَ صَدَقَتُهُ ؟ قَالَ: " الْعُشْرُ "، قَالَ: " فَكَذَلِكَ الْمَالُ عَلَى أَكْثَرَ مِنْ ذَلِكَ إِذَا كَانَ يُسْقَى بِالْعَيْنِ أَكْثَرَ مِمَّا يُسْقَى بِالدَّلْوِ فَفِيهِ الْعُشُورُ، وَإِنْ كَانَ يُسْقَى بَالدَّلْوِ أَكْثَرَ مِمَّا يُسْقَى بِالنَّجْلِ فَفِيهِ نِصْفُ الْعُشْرِ "، قُلْتُ: وَهُوَ بِمَنْزِلَةِ ذَلِكَ أَيْضًا الْمَالُ يَكُونُ بَعْلًا، أَوْ عَثَرِيًّا عَامَّةَ الزَّمَانِ، ثُمَّ يَحْتَاجُ الْمَرَّةَ إِلَى الْبِئْرِ، فَيُسْقَى بِالدَّلْوِ ؟ قَالَ: " نَعَمْ
Translation
✧ What do you think about wealth [land] that is irrigated by a spring most of the time, then it needs a well and is irrigated by it, then it returns to the spring; how is its zakāh? He said: “One-tenth.” He said: “Likewise, if wealth is irrigated by the spring more than by the bucket, it owes one-tenth; but if it is irrigated by the bucket more than by the spring, it owes half of one-tenth.” I said: “Is it likewise for wealth that is rain-fed or watered by flood most of the time, then sometimes needs a well and is irrigated by bucket?” He said: “Yes.”
