عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
سَمِعْتُ أَنَّ رَجُلًا إِذَا ابْتَاعَ أَرْضًا أَوْ دَارًا فَوَجَدَ فِيهَا مَالًا عَادِيًّا، فَهُوَ لَهُ، وَهُوَ مَغْنَمٌ، وَإِنْ وَجَدَ مَالًا مِنْ مَالِ هَذِهِ الْأُمَّةِ فَهُوَ لَهُ، إِلَّا أَنْ يَأْتِيَ الَّذِي قَبْلَهُ بِبَيِّنَةٍ، وَآيَةٍ مَعْرُوفَةٍ
Translation
✧ I heard that if a man buys land or a house and finds in it ancient (ʿādī) treasure, it is his, and it is spoils of war. But if he finds money from the wealth of this community, it is his, unless the previous owner brings clear evidence and a recognized sign.
