✧ The prayer over the child of adultery and the stoned adulterer

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ:

سَأَلْتُ عَطَاءً عَنْ وَلَدِ الزِّنَا حِينَ يُولَدُ بَعْدَمَا اسْتَهَلَّ أَيُصَلَّى عَلَيْهِ ؟ قَالَ: " نَعَمْ، قُلْتُ: كَيْفَ وَهُوَ كَذَلِكَ ؟ قَالَ: " مِنْ أَجْلِ أَنَّهُ وُلِدَ عَلَى الْفِطْرَةِ فِطْرَةِ الْإِسْلَامِ "، قُلْتُ: فَكَبِرَ فَكَانَ رَجُلَ سُوءٍ ؟ قَالَ: " وَيُصَلَّى عَلَيْهِ "، قُلْتُ: فَأُمُّهُ مَاتَتْ فِي نِفَاسِهَا ؟ قَالَ: " فَلَا أَدَعُهَا "، وَهُوَ يَقُولُ: ﴿إِنَّ اللهَ لا يَغْفِرُ أَنْ يُشْرَكَ بِهِ ﴾، وَقَالَ لِي عَطَاءٌ بَعْدَ ذَلِكَ: " يُصَلَّى عَلَى وَلَدِ الزِّنَا إِذَا اسْتَهَلَّ، وَعَلَى أُمِّهِ إِنْ مَاتَتْ مِنْ نِفَاسِهَا، وَعَلَى الْمُتَلَاعِنَيْنِ، وَعَلَى الَّذِي يُقَادُ مِنْهُ، وَعَلَى الْمَرْجُومِ وَعَلَى الَّذِي يُزَاحَفُ فَيَفِرُّ فَيُقْتَلُ، وَعَلَى الَّذِي يَمُوتُ مِيتَةَ السُّوءِ، قَالَ: " لَا أَدَعُ الصَّلَاةَ عَلَى مَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ " قَالَ: قُلْتُ: مِنْ بَعْدِ مَا تَبَيَّنَ لَهُ أَنَّهُ مِنْ أَصْحَابِ الْجَحِيمِ ؟ قَالَ: " فَمَنْ يَعْلَمُ أَنَّ هَؤُلَاءِ مِنْ أَصْحَابِ الْجَحِيمِ ؟

Translation

✧ I asked Ata' about the child of adultery when he is born after he has cried: should prayer be offered over him? He said: "Yes." I said: "How, when he is like that?" He said: "Because he was born upon the fitrah, the fitrah of Islam." I said: "What if he grows up and becomes an evil man?" He said: "Prayer is still offered over him." I said: "What if his mother dies during her post-partum bleeding?" He said: "I would not leave her," while he also said: {Indeed, Allah does not forgive that partners be associated with Him}. And Ata' said to me after that: "Prayer is offered over the child of adultery if he cried at birth, and over his mother if she dies from post-partum bleeding, and over the two who have sworn mutual cursing, and over the one who is executed in retribution, and over the stoned one, and over the one who is engaged in battle and flees and is killed, and over the one who dies an evil death." He said: "I do not abandon prayer over anyone who said 'There is no god but Allah.'" I said: "Even after it becomes clear to him that he is one of the people of Hell?" He said: "Who knows that these are among the people of Hell?"
