The Prophet ﷺ ruled: Whenever a group of people in a melee disperse after a killing or a wound, and the wound leads the wounded person to death, and the wounded person accuses some of those who struck him and not others, and the people of the melee testify to that, those of whom no transgression is known and who are not suspected of enmity between them and the accused, then the family of the slain person may ward off [the claim] by oaths, because of the [wound] they had from the wariness of the passers-by [wirb al-mārrah]. So they swear fifty oaths: By Allah, other than Whom there is no god, that so-and-so killed our companion, and he died only from his blow.
