فِي رَجُلٍ قَتَلَ رَجُلًا وَلَهُ أَخَوَانِ فَعَفَا أَحَدُهُمَا، ثُمَّ قَتَلَهُ الْآخَرُ قَبْلَ أَنْ يَرْفَعَهُ إِلَى الْإِمَامِ قَالَ: " هُوَ خَطَأٌ عَلَيْهِ الدِّيَةُ يُؤْخَذُ مِنْهُ نِصْفُ الدِّيَةِ
