عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ جَابِرٍ، وَمُحَمَّدِ بْنِ سَالِمٍ، عَنِ الشَّعْبِيِّ قَالَ:
إِذَا مَاتَتِ الْمَرْأَةُ وَتَرَكَتْ مَوَالِيَ فَالْمِيرَاثُ لِوَلَدِهَا وَالْعَقْلُ عَلَيْهِمْ قَالَ: وَكَانَ ابْنُ أَبِي لَيْلَى يَقْضِي بِهِ
