✧ Is the Slave Sold for His Debt If He Was Permitted to Trade, or the Free Man? And What If the Master and the Slave Die and There Is a Debt

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، قَالَ: أَصْحَابُنَا حَمَّادٌ، وَغَيْرُهُ فَقَالُوا:
إِذَا أَعْتَقَهُ، وَعَلَيْهِ دَيْنٌ فَقِيمَةُ الْعَبْدِ عَلَى السَّيِّدِ، وَيَبِيعُهُ غُرَمَاؤُهُ فِيمَا زَادَ عَلَى الْقِيمَةِ، وَهُوَ أَحَبُّ الْقَوْلَيْنِ. فَإِنْ فَضَلَ شَيْءٌ عَنْ قِيمَةِ الْعَبْدِ أُتْبِعَ بِهِ الْعَبْدُ ".
