عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي الْمُشْرِكَيْنِ الْمُعَاهَدَيْنِ يُسْلِمُ أَحَدُهُمَا مَتَى مَا رُفِعَ إِلَى السُّلْطَانِ، فَعَرَضَ عَلَيْهِ الْإِسْلَامَ فَرَّقَ بَيْنَهُمَا. قَالَ: وَقَالَ الشَّعْبِيُّ: كُلُّ فُرْقَةٍ طَلَاقٌ. قَالَ: وَقَالَ أَصْحَابُنَا: كُلُّ شَيْءٍ جَاءَ مِنْ قِبَلِهِ فَهُوَ طَلَاقٌ، وَكُلُّ شَيْءٍ جَاءَ مِنْ قِبَلِهَا فَهُوَ فُرْقَةٌ وَلَيْسَ بِطَلَاقٍ
