عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ
فِي رَجُلٍ لَهُ حَقٌّ عَلَى رَجُلٍ، فَقَالَ الْمَطْلُوبُ: قَدْ قَضَيْتُ، وَإِلَّا فَامْرَأَتُهُ طَالِقٌ، قَالَ الطَّالِبُ: امْرَأَتُهُ طَالِقٌ إِنْ كُنْتَ قَضَيْتَنِي، قَالَ: " عَلَى الْمَطْلُوبِ الْبَيِّنَةُ أَنَّهُ قَضَاهُ، فَإِنْ أَقَامَ الْبَيِّنَةَ طُلِّقَتِ امْرَأَةُ الطَّالِبِ، وَإِنْ لَمْ يَأْتِ بَيِّنَةً حَلَفَ الطَّالِبُ بِاللهِ مَا قَضَانِي، ثُمَّ طُلِّقَتِ امْرَأَةُ الْمَطْلُوبِ
