عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ قَالَ:
قُلْتُ لَهُ: رَجُلٌ تَزَوَّجَ امْرَأَةً وَفَوَّضَ إِلَيْهِ، فَلَمَّا كَانَ قَبْلَ أَنْ يُجَامِعَهَا أُخِذَ بَصَدَاقِهَا، فَقِيلَ لَهُ: افْرِضْ لَهَا مِثْلَ صَدَاقِ مِثْلِهَا، قَالَ: " لَيْسَ ذَلِكَ لَهُمْ، إِنَّمَا هُوَ مَا شَاءَ زَوْجُهَا ". قُلْتُ: فَأَرْسَلَ إِلَيْهَا بِشَيْءٍ يَتَحَلَّلُهَا بِهِ، ثُمَّ دَخَلَ عَلَيْهَا فَأَصَابَهَا. ثُمَّ مَاتَ أَوْ طَلَّقَهَا، وَلَمْ يُسَمِّ لَهَا صَدَاقَهَا، قَالَ: " لَيْسَ لَهُمْ إِلَّا مَا إِذَا تَوَصَّوْا ". قُلْتُ: فَمَاتَ وَلَمْ يُسِمِّ صَدَاقًا، وَقَدْ كَانَ أَصَابَهَا ! قَالَ: " لَيْسَ لَهَا إِلَّا الْمِيرَاثُ، وَمَا شَاءَ الْوَارِثُ
Translation
✧ I said to him: 'A man married a woman and delegated it to him, and before he had intercourse with her, her dower was demanded. It was said to him: "Fix for her the like of the dower of her peers." He said: "That is not for them; it is only whatever her husband wishes." I said: "Then he sent her something to make her consent, then entered upon her and had intercourse with her. Then he died or divorced her, and he had not named her dower for her." He said: "They have nothing except what they mutually agree upon." I said: "Then he died and did not name a dower, and he had had intercourse with her!" He said: "She has nothing except the inheritance and whatever the heir wishes."
