10340 10272 - عَبْدُ الرَّزَّاقِ، عَنْ هِشَامِ بْنِ مُحَمَّدٍ مِثْلَهُ. متن مخفيخَرَجَ الْأَشْعَثُ بْنُ قَيْسٍ يُشَيِّعُ رَجُلًا أَحْسَبُهُ مِنْ قُرَيْشٍ فَرَأَى امْرَأَتَهُ أَوِ امْرَأَةً مَعَهُ فَأَعْجَبَتْهُ فَقُضِيَ لِلرَّجُلِ أَنْ مَاتَ فِي سَفَرِهِ فَرَجَعَ أَهْلُهُ إِلَى الْكُوفَةِ فَخطَبَ الْأَشْعَثُ تِلْكَ الْمَرْأَةَ فَقَالَتْ أَتَزَوَّجُكَ عَلَى حُكْمِي فَتَزَوَّجَهَا فَلَمَّا دَخَلَ بِهَا وَمَكَثَ مَا مَكَثَ طَلَّقَهَا ثُمَّ قَالَ احْتَكِمِي مَا شِئْتِ فَقَالَتْ أَحْتَكُمْ فُلَانًا وَفُلَانًا عَبِيدًا لِأَبِيهِ فَقَالَ أَمَّا هَؤُلَاءِ فَلَا وَلَكِنِ احْتَكِمِي مِنْ مَالِي فَخَاصَمَهَا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي عَشِقْتُ هَذِهِ الْمَرْأَةَ فَقَالَ ذَلِكَ مَا لَمْ تَمْلِكْ قَالَ ثُمَّ تَزَوَّجْتُهَا عَلَى حُكْمِهَا ثُمَّ طلَّقْتُهَا قَبْلَ أَنْ أُرْضِيَهَا فَرَدَّ ذَلِكَ عُمَرُ وَقَالَ امْرَأَةٌ مِنَ الْمُسْلِمِينَ لَهَا مَا لِامْرَأَةٍ مِنَ الْمُسْلِمِينَ وَلَمْ يَجْعَلْ لَهَا حُكْمًا وَجَعَلَ لَهَا صَدَاقَ الْمَرْأَةِ مِنْ نِسَائِهَا سند مخفيعَبْدُ الرَّزَّاقِ، عَنْ هِشَامِ بْنِ مُحَمَّدٍ عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ قَالَ
Translation
✧ Al-Ash'ath b. Qays went out bidding farewell to a man, I think from Quraysh, and saw his wife, or a woman with him, and she pleased him. It was decreed for the man to die on his journey, and his family returned to Kufah. Al-Ash'ath proposed to that woman, and she said: 'I marry you according to my judgment!' So he married her. When he had consummated the marriage and remained as long as he remained, he divorced her, then said: 'Judge for yourself what you want!' She said: 'I judge so-and-so and so-and-so, slaves of his father.' He said: 'As for those, no, but judge from my wealth.' She brought a dispute to Umar b. al-Khattab. He said: 'O Commander of the Believers, I fell in love with this woman.' He said: 'That is as long as you do not possess her.' He said: 'Then I married her according to her judgment, then I divorced her before appeasing her.' Umar rejected that and said: 'A woman of the Muslims has what any woman of the Muslims has.' He did not make any judgment for her, but gave her the dower of a woman of her peers. Abd al-Razzaq reported from Hisham b. Muhammad, from Ayyub, from Ibn Sirin.
