✧ Marriage, divorce, and taking back without evidence

عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً، ثُمَّ مَكَثَتْ ثَلَاثَ سِنِينَ، ثُمَّ وَضَعَتْ، فَقَالَ: قَدِ ارْتَجَعْتُكِ، وَقَالَتْ هِيَ: لَمْ تُرَاجْعِنِي رَجْعَةً؛ لِأَنَّ الْوَلَدَ لَمْ يَكُنْ إِلَّا مِنْ جِمَاعٍ بَعْدَ الطَّلَاقِ، وَالْجِمَاعُ رَجْعَةٌ. قَالَ: " فَإِنْ كَانَ ذَلِكَ سَنَتَيْنِ أَوْ أَقَلَّ مِنْ ذَلِكَ سُئِلَ الْبَيَّنَةَ عَلَى الرَّجْعَةِ، وَإِلَّا أُلْزِمَ الْوَلَدَ وَبَانَتْ مِنْهُ؛ لِأَنَّ الْوَلَدَ يَكُونُ لِسَنَتَيْنِ
Translation
✧ About a man who divorced his wife once, then she remained three years, then gave birth. He said: 'I have taken you back,' but she said: 'You did not take me back with a taking back, because the child could only have come from intercourse after the divorce, and intercourse is a taking back.' He said: 'If that is two years or less, he is asked for clear evidence of the taking back, otherwise the child is attributed to him and she is separated from him, because the child can be from up to two years.'
