✧ Inheritance of the apostate

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ:
النَّاسُ فَرِيقَانِ؛ مِنْهُمْ مَنْ يَقُولُ: مِيرَاثُ الْمُرْتَدِّ لِلْمُسْلِمِينَ؛ لِأَنَّهُ سَاعَةَ يَكْفُرُ يُوقَفُ عَنْهُ، فَلَا يَقْدِرُ مِنْهُ عَلَى شَيْءٍ حَتَّى يَنْظُرَ أَيُسْلِمُ أَوْ يَكْفُرُ. مِنْهُمُ النَّخَعِيُّ، وَالشَّعْبِيُّ، وَالْحَكَمُ بْنُ عُتَيْبَةَ. وَفَرِيقٌ يَقُولُ: لِأَهْلِ دِينِهِ
Translation
✧ People are of two groups: among them are those who say the inheritance of the apostate belongs to the Muslims, because the moment he disbelieves, it is withheld from him, and he cannot dispose of any of it until it is seen whether he becomes Muslim or remains a disbeliever. Among them are al-Nakha'i, al-Sha'bi, and al-Hakam b. 'Utaybah. Another group says it belongs to the people of his religion.
