✧ Demolishing their churches and whether they may strike the naqus

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ التَّيْمِيِّ، عَنْ أَبِيهِ، عَنْ شَيْخٍ مِنْ أَهْلِ الْمَدِينَةِ - يُقَالُ لَهُ: حَنَشٌ أَبُو عَلِيٍّ - عَنْ عِكْرِمَةَ مَوْلَى ابْنِ عَبَّاسٍ قَالَ:
سُئِلَ ابْنُ عَبَّاسٍ: هَلْ لِلْمُشْرِكِينَ أَنْ يَتَّخِذُوا الْكَنَائِسَ فِي أَرْضِ الْعَرَبِ ؟ فَقَالَ ابْنُ عَبَّاسٍ: أَمَّا مَا مَصَّرَ الْمُسْلِمُونَ فَلَا تُرْفَعُ فِيهِ كَنِيسَةٌ، وَلَا بِيعَةٌ، وَلَا بَيْتُ نَارٍ، وَلَا صَلِيبٌ، وَلَا يُنْفَخُ فِيهِ بُوقٌ، وَلَا يُضْرَبُ فِيهِ نَاقُوسٌ، وَلَا يُدْخَلُ فِيهِ خَمْرٌ وَلَا خِنْزِيرٌ. وَمَا كَانَ مِنْ أَرْضٍ صُولِحَتْ صُلْحًا فَعَلَى الْمُسْلِمِينَ أَنْ يَفُوا لَهُمْ بِصُلْحِهِمْ
Translation
✧ Ibn Abbas was asked: May the polytheists build churches in the land of the Arabs? Ibn Abbas said: As for what the Muslims have established as amsar, no church, no synagogue, no fire temple, and no cross may be raised in them, nor may a horn be blown in them, nor a naqus struck in them, nor wine or pigs be brought into them. As for any land that was reconciled by treaty, the Muslims must fulfill their treaty for them.
