أَخْبَرَنَا عَبْدُ الرَّزَّاقِ عَنِ الثَّوْرِيِّ،
وَسُئِلَ عَنْ رَقِيقِ الْعَجَمِ يَخْرُجُونَ مِنَ الْبَحْرِ وَغَيْرِهِ، أَيُبَاعُونَ مِنَ الْيَهُودِ وَالنَّصَارَى ؟ فَقَالَ: إِذَا كَانُوا كِبَارًا عُرِضَ عَلَيْهِمُ الْإِسْلَامُ، فَإِنْ أَسْلَمُوا وَإِلَّا بِيعُوا مِنَ الْيَهُودِ وَالنَّصَارَى إِنْ شَاءَ صَاحِبُهُمْ. وَالَّذِي يُسْتَحَبُّ مِنْ ذَلِكَ أَنَّ الْيَهُودَ إِذَا مَلَكَهُمُ الْمُسْلِمُ بِبَيْعٍ أَوْ سَبْيٍ فَإِنَّهُ يَدْعُوهُمْ إِلَى الْإِسْلَامِ، فَإِنْ أَبَوْا إِلَّا التَّمَسُّكَ بِدِينِهِمْ فَإِنَّ الْمُسْلِمَ إِنْ شَاءَ بَاعَهُمْ مِنْ أَهْلِ الذِّمَّةِ، وَلَا يَبِيعُهُمْ مِنْ أَحَدٍ مِنْ أَهْلِ الْحَرْبِ. وَإِنْ كَانُوا عَلَى غَيْرِ دِينٍ مِثْلَ الْهِنْدِ وَالزِّنْجِ فَإِنَّ الْمُسْلِمَ لَا يَبِيعُهُمْ مِنْ أَحَدٍ مِنْ أَهْلِ الذِّمَّةِ، وَلَا مِنْ أَهْلِ الْحَرْبِ، وَلَا يَبِيعُهُمْ إِلَّا مِنَ الْمُسْلِمِينَ؛ لِأَنَّهُمْ يُجِيبُونَ إِذَا دُعُوا وَلَيْسَ لَهُمْ دِينٌ يَتَمَسَّكُونَ بِهِ، وَلَا يَنْبَغِي أَنْ يُتْرَكَ الْيَهُودُ وَالنَّصَارَى أَنْ يُهَوِّدُوهُمْ وَلَا يُنَصِّرُوهُمْ، وَإِذَا كَانَ الْعَجَمُ صِغَارًا لَمْ يُبَاعُوا مِنَ الْيَهُودِ وَالنَّصَارَى، لَا يُبَاعُونَ إِلَّا مِنَ الْمُسْلِمِينَ
Translation
✧ He was asked about non-Arab slaves who come out from the sea and elsewhere: may they be sold to Jews and Christians? He said: If they are adults, Islam is offered to them. If they accept Islam, so be it; otherwise, they may be sold to Jews and Christians if their owner wishes. What is preferable in this matter is that when a Muslim acquires Jews by sale or captivity, he should invite them to Islam. If they refuse except to hold fast to their religion, the Muslim may, if he wishes, sell them to the protected people (ahl al-dhimmah), but he may not sell them to anyone from the people of war (ahl al-harb). If they are of no religion, such as the Indians and the Zanj, the Muslim may not sell them to anyone from the protected people or from the people of war; he may sell them only to Muslims, because they respond when invited and have no religion to which they cling. Jews and Christians should not be allowed to Judaize or Christianize them. If the non-Arabs are minors, they may not be sold to Jews and Christians; they may be sold only to Muslims.
