أَخْبَرَنَا عَبْدُ الرَّزَّاقِ عَنِ الثَّوْرِيِّ
فِي أُمِّ وَلَدٍ نَصْرَانِيٍّ أَسْلَمَتْ، قَالَ: " تُقَوَّمُ عَلَيْهَا نَفْسُهَا فَتُسْتَسْعَى فِي قِيمَتِهَا، وَتُعْزَلُ مِنْهُ؛ فَإِنْ هُوَ مَاتَ عَتَقَتْ، وَإِنْ هُوَ أَسْلَمَ بَعْدَ سِعَايَتِهَا بِيعَتْ وَلَمْ تَرْجِعْ إِلَيْهِ، وَإِنْ مَاتَ وَهُوَ مُسْلِمٌ أَوْ نَصْرَانِيٌّ فَلَا سِعَايَةَ عَلَيْهَا ". قَالَ الثَّوْرِيُّ فِي مُدَبَّرٍ نَصْرَانِيٍّ مِثْلَ مَا قَالَ فِي أُمِّ وَلَدِهِ. قَالَ الثَّوْرِيُّ فِي ذِمِّيٍّ يُسْلِمُ عِنْدَهُ الْعَبْدُ، فَيُغَيِّبُهُ أَوْ يَكْتُمُهُ، قَالَ: " يُعَزَّرُ وَيُبَاعُ
Translation

machine translationʿAbd al-Razzāq informed us, from al-Thawrī
✧ Concerning an umm walad of a Christian who became Muslim, he said: Her value is assessed for her, and she works to pay off her value, and she is separated from him. If he dies, she is freed. If he becomes Muslim after her striving, she is sold and does not return to him. If he dies while Muslim or Christian, there is no striving upon her. Al-Thawri said concerning a Christian mudabbar the like of what he said concerning his umm walad. Al-Thawri said concerning a dhimmi with whom a slave becomes Muslim, and he makes him disappear or conceals him: He is disciplined and sold.
