أَخْبَرَنَا عَبْدُ الرَّزَّاقِ عَنِ ابْنِ جُرَيْجٍ قَالَ:
سُئِلَ ابْنُ شِهَابٍ عَنْ نَصْرَانِيٍّ كَانَتْ تَحْتَهُ أَمَةٌ لَهُ نَصْرَانِيَّةٌ، فَوَلَدَتْ مِنْهُ، ثُمَّ أَسْلَمَتْ قَالَ: " يُفَرِّقُ الْإِسْلَامُ بَيْنَهُمَا، وَتُعْتَقُ هِيَ وَوَلَدُهُ ". قَالَ ابْنُ جُرَيْجٍ: وَأَنَا أَقُولُ: لَا تُعْتَقُ حَتَّى يُسْتَدْعَى سَيِّدُهَا إِلَى الْإِسْلَامِ، فَإِنْ أَبَى أَنْ يُسْلِمَ عَتَقَتْ، وَإِنْ أَسْلَمَ كَانَتْ أَمَتَهُ
Translation
✧ Ibn Shihab was asked about a Christian who had under him a Christian slave-girl of his, and she bore him a child, then she became Muslim. He said: Islam separates them, and she and his child are freed. Ibn Jurayj said: But I say: She is not freed until her master is summoned to Islam; if he refuses to become Muslim, she is freed, and if he becomes Muslim, she remains his slave-girl.
