Notes

machine translationHe said: On this topic there is also a narration from ʿĀʾishah. Abū ʿĪsā said: The hadith of Ibn ʿAbbās is a good and sound (ḥasan ṣaḥīḥ) hadith, and some of the people of knowledge act upon this. Sufyān al-Thawrī and the people of Kūfah hold this view.

machine translationRegarding the statement of Ibn ʿAbbās that the Prophet ﷺ married Maymūnah while he was in a state of iḥrām, which was narrated by al-Bukhārī, Muslim and the authors of the Sunan: Ibn al-Musayyab and others held that he was mistaken in it, for he was alone in reporting it, and Maymūnah and Abū Rāfiʿ contradicted him, narrating that he married her while he was not in iḥrām. Their report is more deserving of acceptance, because Maymūnah is the wife herself and Abū Rāfiʿ was the envoy between them, so the two of them knew the event better than Ibn ʿAbbās, since he did not have the connection to the story that they had, and because he was younger than they were at that time, as he was not of their age nor close to it. And if it was not a mistake on their part,

machine translationIbn ʿAbbās was mistaken about the marriage to Maymūnah while he was in iḥrām, even though she was his maternal aunt. He ﷺ married her only after he had left the state of iḥrām.

    in جامع الترمذي, p. 868
  • Ibn ʿAbd al-Barr

machine translationI do not know of any Companion who narrated that he married her while in iḥrām except Ibn ʿAbbās. The reports of those mentioned conflict with his report, and the heart inclines more towards the report of the group, because a single narrator is closer to error.

  • Ibn ʿAbd al-Barr

machine translationI do not know of any Companion from whom it was narrated that he, peace be upon him, married Maymūnah while in iḥrām except Ibn ʿAbbās, and his hadith on that is sound and established concerning the marriage to Maymūnah.
