"A Man from the Ansar freed six slaves of his upon his death, and he did not have any wealth aside from them. That was conveyed to the Prophet ﷺ, and he said some harsh words about him." He said: "Then he called for them and he divided them and had them draw lots. So he freed two of them and left four as slaves."

machine translationIt has been narrated through more than one route from ʿImrān b. Ḥuṣayn. He said: On this topic there is also a narration from Abū Hurayrah. Abū ʿĪsā said: The hadith of ʿImrān b. Ḥuṣayn is a good and sound (ḥasan ṣaḥīḥ) hadith. Some of the people of knowledge among the Companions of the Prophet ﷺ and others act upon this, and it is the view of Mālik, al-Shāfiʿī, Aḥmad and Isḥāq; they hold that drawing lots is to be used in this case and in others. As for some of the people of knowledge among the people of Kufa and others, they did not hold drawing lots to be valid, and said: One third of each slave is freed, and he is made to work to earn the remaining two thirds of his value. Abū al-Muhallab's name is ʿAbd al-Raḥmān b. ʿAmr al-Jarmī, and he is not Abū Qilābah; it is also said (that his name is) Muʿāwiyah b. ʿAmr. And Abū Qilābah al-Jarmī's name is ʿAbdullāh b. Zayd.
