Show the chain

"Whichever man is given a lifelong gift for himself and his offspring, then it belongs to the one whom it was given, it does not return to the one who gave it, for he has given a gift which shall be included in the inheritance."

machine translationAbū ʿĪsā said: This is a good and sound (ḥasan ṣaḥīḥ) hadith. Maʿmar and more than one narrator reported it from al-Zuhrī in the same way as the narration of Mālik. Some of them narrated it from al-Zuhrī without mentioning in it "and to his heirs." Some of the people of knowledge act upon this. They said: If he says, "It is yours for your lifetime and for your heirs," then it belongs to the one to whom it was granted as a lifetime grant (ʿumrā) and does not return to the first owner. But if he does not say "for your heirs," then it returns to the first owner when the grantee dies. This is the view of Mālik b. Anas and al-Shāfiʿī. It has been narrated through more than one route from the Prophet ﷺ that he said: "The ʿumrā is permissible for its people." Some of the people of knowledge act upon this. They said: When the grantee dies, it belongs to his heirs, even if it was not made for his heirs. This is the view of Sufyān al-Thawrī, Aḥmad and Isḥāq.
