حَدَّثَنَا إِسْمَاعِيلُ بْنُ الْحَسَنِ الْخَفَّافُ الْمِصْرِيُّ ثنا أَحْمَدُ بْنُ صَالِحٍ ثنا ابْنُ وَهْبٍ قَالَ سَمِعْتُ مَالِكًا وَيُونُسَ بْنَ يَزِيدَ وَغَيْرَهُمَا أَنَّ ابْنَ شِهَابٍ أَخْبَرَهُمْ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَأَبِي هُرَيْرَةَ
أَنَّ رَجُلَيْنِ أَتَيَا رَسُولَ اللهِ ﷺ يَخْتَصِمَانِ إِلَيْهِ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ اقْضَ بَيْنَنَا بِكِتَابِ اللهَ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجَلْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ «تَكَلَّمْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَإِنَّهُ زَنَى بِامْرَأَتِهِ فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِئَةِ شَاةٍ وَجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ» وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الْأَسْلَمِيَّ أَنْ يُرْجَمَ امْرَأَةَ الْآخَرَ إِنِ اعْتَرَفَتْ فَاعْتَرَفَتْ فَرَجَمَهَا

✧ That two men came to the Messenger of God ﷺ disputing before him. One of them said: “O Messenger of God, judge between us according to the Book of God,” and the other, who was the more knowledgeable of them, said: “Yes, so judge between us according to the Book of God, and give me permission to speak.” He said: “Speak.” He said: “My son was a hired worker for this man, and he committed adultery with his wife. I was told that my son was subject to stoning, so I ransomed him with a hundred sheep and a slave girl of mine. Then I asked the people of knowledge, and they told me that my son was only subject to a hundred lashes and exile for a year, and that stoning was only upon his wife.” The Messenger of God ﷺ said: “Indeed, by the One in Whose hand is my soul, I will certainly judge between you according to the Book of God: as for your sheep and your slave girl, they are to be returned to you.” So he had his son flogged with a hundred lashes and exiled for a year, and he ordered Unays al-Aslami to stone the other man's wife if she confessed. She confessed, and he stoned her.
