حَدَّثَنَا الْمِقْدَامُ بْنُ دَاوُدَ الْمِصْرِيُّ ثنا أَسَدُ بْنُ مُوسَى ثنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ أَيُّوبَ السَّخْتِيَانِيِّ قَالَ سَمِعْتُ أَبَا الْمَلِيحِ

عَنْ أَبِيهِ وَكَانَ قَدْ صَحِبَ رَسُولَ اللهِ ﷺ قَالَ كَانَتْ فِيهَا امْرَأَتَانِ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودٍ فَقَتَلَهَا وَقَتَلَتْ مَا فِي بَطْنِهَا فَقَضَى النَّبِيُّ ﷺ فِي الْمَرْأَةِ بِالْعَقْلِ وَفِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ أَوْ بِفَرَسٍ أَوْ بَعِيرَيْنِ مِنَ الْإِبِلِ أَوْ كَذَا وَكَذَا مِنَ الْغَنَمِ فَقَالَ رَجُلٌ مِنْ رَهْطِ الْقَاتِلَةِ كَيْفَ نَعْقِلُ يَا رَسُولَ اللهِ مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللهِ ﷺ «أَسَجَّاعَةٌ أَنْتَ؟» وَقَضَى رَسُولُ اللهِ ﷺ «أَنَّ مِيرَاثَ الْمَرْأَةِ لِزَوْجِهَا وَوَلَدِهَا وَأَنَّ الْعَقْلَ عَلَى عَصَبَةِ الْقَاتِلَةِ»

✧ From his father, who had accompanied the Messenger of Allah ﷺ, he said: There were two women, one of whom struck the other with a tent pole, killing her and what was in her womb. The Prophet ﷺ ruled that the blood money for the woman was to be paid, and for the fetus a ghurra, a male or female slave, or a horse, or two camels, or such and such from sheep. A man from the clan of the killer said: "How can we pay blood money, O Messenger of Allah, for one who did not eat, drink, or cry out? Such a one should be disregarded." The Messenger of Allah ﷺ said: "Are you a rhymester?" And the Messenger of Allah ﷺ ruled that the inheritance of the woman belonged to her husband and her child, and that the blood money was upon the male relatives of the killer.
