حَدَّثَنَا أَبُو يَزِيدَ الْقَرَاطِيسِيُّ وَيَحْيَى بْنُ أَيُّوبَ الْعَلَّافُ قَالَا ثنا سَعِيدُ بْنُ أَبِي مَرْيَمَ ثنا ابْنُ أَبِي الزِّنَادِ حَدَّثَنِي أَبِي أَنَّهُ أَخَذَ هَذِهِ الرِّسَالَةَ مِنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ لِعَبْدِ اللهِ مُعَاوِيَةَ أَمِيرِ الْمُؤْمِنِينَ مِنْ زَيْدِ بْنِ ثَابِتٍ «§سَلَامٌ عَلَيْكَ أَمِيرَ الْمُؤْمِنِينَ وَرَحْمَةُ اللهِ فَإِنِّي أَحْمَدُ إِلَيْكَ اللهَ الَّذِي لَا إِلَهَ إِلَّا هُوَ أَمَا بَعْدُ فَإِنَّكَ كَتَبْتَ تَسْأَلُنِي
عَنْ مِيرَاثِ الْجَدِّ وَالْأُخْوَةِ وَإِنَّ الْكَلَالَةَ وَكَثِيرًا مِمَّا يُقْضَى بِهِ فِي هَذِهِ الْمَوَارِيثِ لَا يَعْلَمُ مَبْلَغُهَا إِلَّا اللهُ وَقَدْ كُنَّا نَحْضُرُ مِنْ ذَلِكَ أُمُورًا عِنْدَ الْخُلَفَاءِ بَعْدَ رَسُولِ اللهِ ﷺ فَوَعِينَا مِنْهَا مَا شِئْنَا أَنْ نَعِيَ فَنَحْنُ نُفْتِي بِهِ بَعْدُ مَنِ اسْتَفْتَانَا فِي الْمَوَارِيثِ»

✧ About the inheritance of the grandfather and brothers, and that kalalah and much of what is adjudicated in these inheritances—none knows its full extent except Allah. We used to attend matters of that sort before the caliphs after the Messenger of Allah ﷺ, and we retained of them as much as we wished to retain, and with it we still give rulings to whoever asks us about inheritances.
