حَدَّثَنَا يُوسُفُ الْقَاضِي ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ قَالَ كَتَبَ إِلَيَّ يَعْلَى بْنُ حَكِيمٍ وَسَمِعْتُهُ مِنْهُ بَعْدُ قَالَ سَأَلْتُ سُلَيْمَانَ بْنَ يَسَارٍ فَقَالَ عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ

«كُنَّا نُحَاقِلُ الْأَرْضَ فَنُكْرِيهَا عَلَى الثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى فَأَمَرَنَا بِالْأَرْضِ أَنْ نَزْرَعَهَا أَوْ نُزْرِعَهَا وَكَرِهَ كِرَاءَهَا وَمَا سِوَى ذَلِكَ»

✧ “We used to practice muḥāqalah with land, leasing it for a third, a quarter, and a specified amount of food. Then he commanded us concerning the land that we should cultivate it or have it cultivated, and he disliked leasing it for anything other than that.”
