حَدَّثَنَا عُمَرُ بْنُ حَفْصٍ السَّدُوسِيُّ ثنا عَاصِمُ بْنُ عَلِيٍّ ح وَحَدَّثَنَا عُبَيْدُ بْنُ غَنَّامٍ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ح وَحَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ سَالِمٍ الرَّازِيُّ ثنا سَهْلُ بْنُ عُثْمَانَ ح وَحَدَّثَنَا مُعَاذُ بْنُ الْمُثَنَّى ثنا مُسَدَّدٌ قَالُوا ثنا أَبُو الْأَحْوَصِ ثنا سِمَاكُ بْنُ حَرْبٍ عَنْ عَلْقَمَةَ بْنِ وَائِلِ بْنِ حُجْرٍ عَنْ أَبِيهِ قَالَ

جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ هَذَا قَدْ غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لِأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي فِي يَدِي أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ رَسُولُ اللهِ ﷺ «أَلَكَ بَيِّنَةٌ» ؟ قَالَ لَا قَالَ «فَلَكَ يَمِينُهُ» قَالَ يَا رَسُولَ اللهِ إِنَّهُ رَجُلٌ فَاجِرٌ لَا يُبَالِي مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ فَقَالَ النَّبِيُّ ﷺ «لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ» فَانْطَلَقَ لِيَحْلِفَ فَلَمَّا أَدْبَرَ قَالَ رَسُولُ اللهِ ﷺ «أَمَا إِنَّهُ إِنْ حَلَفَ عَلَى مَالِهِ لِيَأْكُلَهُ ظُلْمًا لَيَلْقَيَنَّ اللهَ وَهُوَ عَنْهُ مُعْرِضٌ»

✧ A man from Ḥaḍramawt and a man from Kindah came to the Messenger of God ﷺ. The Ḥaḍramī said: O Messenger of God, this man has seized from me land that belonged to my father. The Kindī said: It is my land, in my possession; I cultivate it. He has no right in it. The Messenger of God ﷺ said: “Do you have evidence?” He said: No. He said: “Then his oath is yours.” He said: O Messenger of God, he is a wicked man who does not care what he swears to; he does not refrain from anything. The Prophet ﷺ said: “You have from him nothing but that.” He went off to swear. When he turned away, the Messenger of God ﷺ said: “Indeed, if he swears falsely about his property to consume it wrongfully, he will surely meet God while He is turning away from him.”
