حَدَّثَنَا مُحَمَّدُ بْنُ عُثْمَانَ بْنِ أَبِي شَيْبَةَ وثنا عَلِيُّ بْنُ سَعِيدٍ الرَّازِيُّ قَالَا ثنا أَبُو كُرَيْبٍ ثنا عَبْدُ اللهِ بْنُ إِسْمَاعِيلَ عَنِ الشَّيْبَانِيِّ عَنْ مُحَمَّدِ بْنِ عُبَيْدِ اللهِ عَنْ وَرَّادٍ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ قَالَ
أُتِيَ رَسُولُ اللهِ ﷺ بِامْرَأَةٍ ضَرَبَتْ ضَرَّتَهَا بِعَمُودٍ فَقَتَلَتْهَا وَقَتَلَتْ مَا فِي بَطْنِهَا فَجَعَلَ رَسُولُ اللهِ ﷺ عَقْلَهَا عَلَى عَصَبَةِ الْمَرْأَةِ وَفِي الْجَنِينِ غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ فَقَامَ رَجُلٌ مِنَ الْقَوْمِ فَقَالَ يَا رَسُولَ اللهِ كَيْفَ نَدِي مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ وَلَا اسْتَهَلَّ؟ فَقَالَ «إِنَّ هَذَا لَيَقُولُ بِقَوْلِ كَاهِنٍ فِيهِ غُرَّةُ عَبْدٍ أَوْ أَمَةٍ»

✧ A woman was brought to the Messenger of God ﷺ who had struck her co-wife with a tent pole and killed her and what was in her womb. The Messenger of God ﷺ made her blood money the responsibility of the woman’s male relatives, and for the fetus there was a ghurra: a male or female slave. A man from the people stood up and said: “O Messenger of God, how can we pay blood money for one who did not eat, drink, cry out, or raise its voice?” He said: “This one speaks with the speech of a soothsayer. For it there is a ghurra: a male or female slave.”
