حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ أَنَا عَبْدُ الرَّزَّاقِ أَنَا مَعْمَرٌ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ هَيَّاجٍ
أَنَّ غُلَامًا لِأَبِيهِ أَبَقَ فَجَعَلَ عَلَيْهِ نَذْرًا لَئِنْ قَدَرَ عَلَيْهِ لَيَقْطَعَنَّ مِنْهُ طَابِقًا فَلَمَّا قَدَرَ عَلَيْهِ أَرْسَلَنِي إِلَى عِمْرَانَ بْنِ الْحُصَيْنِ فَسَأَلْتُهُ فَقَالَ عِمْرَانُ مُرْ أَبَاكَ أَنْ يُعْتِقَ غُلَامَهُ أَوْ يُكَفِّرَ عَنْ يَمِينِهِ «فَإِنَّ رَسُولَ اللهِ ﷺ كَانَ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ» فَأَتَيْتُ سَمُرَةَ فَسَأَلْتُهُ فَقَالَ مِثْلَ قَوْلِ عِمْرَانَ هَكَذَا رَوَاهُ مَعْمَرٌ وَهَمَّامٌ وَقَتَادَةُ عَنِ الْحَسَنِ عَنْ هَيَّاجٍ «وَخَالَفَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ وَهَمَّامُ بْنُ يَحْيَى»
Translation

✧ A slave belonging to his father ran away, so he made a vow that if he caught him, he would cut off one of his fingers. When he did catch him, he sent me to ʿImran b. al-Husayn, so I asked him. ʿImran said, “Tell your father to free his slave or expiate for his oath, for the Messenger of Allah ﷺ used to urge us to give charity and forbid us from mutilation.” Then I came to Samurah and asked him, and he said the same as ʿImran. This is how Maʿmar, Hammam, and Qatadah narrated it from al-Hasan from Hayyaj. Saʿid b. Abi ʿArubah and Hammam b. Yahya disagreed with him.
