حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَضْرَمِيُّ ثنا هُدْبَةُ بْنُ خَالِدٍ ثنا هَمَّامٌ عَنْ قَتَادَةَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ كَانَ زَوْجُ بَرِيرَةَ عَبْدًا أَسْوَدَ يُقَالُ لَهُ مُغِيثٌ قَالَ
ابْنُ عَبَّاسٍ كُنْتُ أُرَاهُ فِي سِكَكِ الْمَدِينَةِ يَعْصِرُ عَيْنَيْهِ فَقَضَى رَسُولُ اللهِ ﷺ فِيهَا بِأَرْبَعٍ شَرَطَ مَوَالِيهَا عَلَيْهَا الْوَلَاءَ فَقَضَى النَّبِيُّ ﷺ «أَنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ وَخَيَّرَهَا فَاخْتَارَتْ نَفْسَهَا وأَمَرَها أَنْ تَعْتَدَّ وَتُصُدِّقَ عَلَيْهَا بِصَدَقَةٍ» وَأَهْدَتْ إِلَى عَائِشَةَ مِنْهَا فَسَأَلَتْ عَائِشَةُ النَّبِيَّ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «هُوَ عَلَيْهَا صَدَقَةٌ وَهُوَ لَنَا هَدِيَّةٌ»

✧ Ibn ʿAbbas said: I saw him in the streets of Madinah pressing his eyes shut. The Messenger of Allah ﷺ ruled concerning it with four—her masters stipulated the walaʾ for themselves. The Prophet ﷺ ruled that the walaʾ belongs to the one who manumits, and he gave her the choice, so she chose herself. He ordered her to observe the waiting period and gave her charity. She sent some of it to ʿAʾishah as a gift, and ʿAʾishah asked the Prophet ﷺ about it. The Messenger of Allah ﷺ said: “It is charity for her, but for us it is a gift.”
