حَدَّثَنَا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْوَشَّاءُ الْأَصْبَهَانِيُّ بِمَدِينَتِهَا، حَدَّثَنَا الْحَسَنُ بْنُ جَهْوَرٍ الْأَهْوَازِيُّ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ يَحْيَى التَّيْمِيُّ، حَدَّثَنَا شُعْبَةُ بْنُ الْحَجَّاجِ عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ، عَنْ إِبْرَاهِيمَ النَّخَعِيِّ، عَنْ عَلْقَمَةَ بْنِ قَيْسٍ، قَالَ:

رَأَيْتُ عَلِيَّ بْنَ أَبِي طَالِبٍ عَلَى مِنْبَرِ الْكُوفَةِ وَهُوَ يَقُولُ: سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: لَا يَزْنِي الزَّانِي وَهُوَ مُؤْمِنٌ، وَلَا يَسْرِقُ السَّارِقُ وَهُوَ مُؤْمِنٌ، وَلَا يَنْتَهِبُ الرَّجُلُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهَا أَبْصَارَهُمْ وَهُوَ مُؤْمِنٌ، وَلَا يَشْرَبُ الرَّجُلُ الْخَمْرَ وَهُوَ مُؤْمِنٌ. فَقَالَ رَجُلٌ: يَا أَمِيرَ الْمُؤْمِنِينَ، مَنْ زَنَا فَقَدْ كَفَرَ ؟ فَقَالَ عَلِيٌّ: إِنَّ رَسُولَ اللهِ ﷺ كَانَ يَأْمُرُنَا أَنْ نُبْهِمَ أَحَادِيثَ الرُّخَصِ، لَا يَزْنِي وَهُوَ مُؤْمِنٌ أَنَّ ذَلِكَ الزِّنَا لَهُ حَلَالٌ، فَإِنْ آمَنَ أَنَّهُ حَلَالٌ فَقَدْ كَفَرَ. وَلَا هُوَ يَسْرِقُ وَهُوَ مُؤْمِنٌ بِتِلْكَ السَّرِقَةِ أَنَّهَا لَهُ حَلَالٌ، فَإِنْ آمَنَ أَنَّهَا حَلَالٌ فَقَدْ كَفَرَ. وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ أَنَّهَا لَهُ حَلَالٌ، فَإِنْ شَرِبَهَا وَهُوَ مُؤْمِنٌ أَنَّهَا لَهُ حَلَالٌ فَقَدْ كَفَرَ. وَلَا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ حِينَ يَنْتَهِبُهَا، وَهُوَ مُؤْمِنٌ أَنَّهَا لَهُ حَلَالٌ فَإِنِ انْتَهَبَهَا وَهُوَ مُؤْمِنٌ أَنَّهَا لَهُ حَلَالٌ فَقَدْ كَفَرَ

✧ I saw 'Ali b. Abi Talib on the pulpit of Kufa saying: I heard the Messenger of Allah ﷺ say: The fornicator does not commit fornication while he is a believer, nor does the thief steal while he is a believer, nor does a man plunder a plunder at which people raise their eyes while he is a believer, nor does a man drink wine while he is a believer. A man said: O Commander of the Faithful, whoever commits fornication has disbelieved? 'Ali said: The Messenger of Allah ﷺ used to command us to leave the hadiths of concessions ambiguous. He does not commit fornication while he is a believer that that fornication is lawful for him; if he believes it is lawful, he has disbelieved. Nor does he steal while he is a believer in that theft that it is lawful for him; if he believes it is lawful, he has disbelieved. Nor does he drink wine when he drinks it while he is a believer that it is lawful for him; if he drinks it while he is a believer that it is lawful for him, he has disbelieved. Nor does he plunder a plunder of high value when he plunders it while he is a believer that it is lawful for him; if he plunders it while he is a believer that it is lawful for him, he has disbelieved.
