حَدَّثَنَا أَحْمَدُ قَالَ: نَا سَعِيدٌ، عَنْ مَنْصُورِ بْنِ أَبِي الْأَسْوَدِ، عَنْ أَبِي يَعْقُوبَ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ عَطَاءٍ. عَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللهِ ﷺ:
أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ بِغَيْرِ وَلِيٍّ فَنِكَاحُهَا بَاطِلٌ، فَنِكَاحُهَا بَاطِلٌ، فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا. وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ ".

✧ Any woman who marries without a guardian, her marriage is invalid, her marriage is invalid. If he consummates the marriage, she is entitled to the dowry because of what he made lawful of her private part. The ruler is the guardian of the one who has no guardian.
