حَدَّثَنَا مُحَمَّدُ بْنُ نُوحِ بْنِ حَرْبٍ، ثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الصَّوَّافُ، نَا بَكْرُ بْنُ بَكَّارٍ، ثَنَا سَعِيدُ بْنُ يَزِيدَ الْبَجَلِيُّ، ثَنَا عَامِرُ بْنُ شَرَاحِيلَ الشَّعْبِيُّ أَنَّهُ:

دَخَلَ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ - أُخْتِ الضَّحَّاكِ بْنِ قَيْسٍ، وَزَوْجُهَا أَبُو عَمْرِو بْنُ حَفْصِ بْنِ عُمَرَ بْنِ الْمُغِيرَةَ الْمَخْزُومِيُّ، فَقَالَتْ: إِنَّ أَبَا عَمْرِو بْنَ حَفْصٍ أَرْسَلَ إِلَيَّ وَهُوَ مُنْطَلِقٌ إِلَى جَيْشٍ إِلَى الْيَمَنِ بِطَلَاقِي، فَسَأَلْتُ أَوْلِيَاءَهُ النَّفَقَةَ عَلَيَّ وَالسُّكْنَى، فَقَالَ أَوْلِيَاؤُهُ: مَا أَرْسَلَ إِلَيْنَا فِي ذَلِكَ بِشَيْءٍ، وَلَا أَوْصَانَا بِهِ، فَانْطَلَقْتُ إِلَى رَسُولِ اللهِ ﷺ فَقُلْتُ: يَا رَسُولَ اللهِ، إِنَّ أَبَا عَمْرِو بْنَ حَفْصٍ أَرْسَلَ إِلَيَّ بِطَلَاقِي، وَطَلَبْتُ السَّكَنَ وَالنَّفَقَةَ، فَقَالَ أَوْلِيَاؤُهُ: لَمْ يُرْسِلْ إِلَيْنَا بِشَيْءٍ، فَقَالَ رَسُولُ اللهِ ﷺ: إِنَّمَا النَّفَقَةُ وَالسُّكْنَى لِلْمَرْأَةِ إِذَا كَانَتْ لِزَوْجِهَا عَلَيْهَا رَجْعَةٌ، فَإِذَا كَانَتْ لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ، فَلَا نَفَقَةَ لَهَا وَلَا سُكْنَى "

✧ He entered upon Fatimah bt. Qays, the sister of al-Dahhak b. Qays; her husband was Abu 'Amr b. Hafs b. 'Umar b. al-Mughirah al-Makhzumi. She said: 'Abu 'Amr b. Hafs sent me my divorce while he was going with an army to Yemen. I asked his guardians for maintenance and lodging, and they said: He did not send us anything about that, nor did he instruct us about it. So I went to the Messenger of Allah ﷺ and said: O Messenger of Allah, Abu 'Amr b. Hafs sent me my divorce, and I asked for lodging and maintenance, but his guardians said: He did not send us anything. The Messenger of Allah ﷺ said: 'Maintenance and lodging are only for the woman if her husband has the right to take her back. But if she is not lawful for him until she marries another husband, then she has no maintenance and no lodging.'
