حَدَّثَنَا أَحْمَدُ، قَالَ: نَا عُثْمَانُ بْنُ هِشَامِ بْنِ الْفَضْلِ بْنِ دَلْهَمٍ الْبَصْرِيُّ قَالَ: نَا مُحَمَّدُ بْنُ كَثِيرٍ الْكُوفِيُّ قَالَ: نَا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ قَالَ:
سُئِلَ ابْنُ مَسْعُودٍ، فَقِيلَ لَهُ: إِنَّ رَجُلًا تَزَوَّجَ امْرَأَتَهُ، وَلَمْ يَفْرِضْ لَهَا صَدَاقًا، وَتُوُفِّيَ عَنْهَا قَبْلَ أَنْ يَدْخُلَ بِهَا ؟ فَقَالَ: " مَا سَمِعْتُ فِيهَا شَيْئًا، فَارْجِعُوا إِلَيَّ أَنْظُرْ فِي ذَلِكَ "، فَرَجَعُوا، ثُمَّ أَتَوْهُ، فَقَالَ: سَأَقُولُ فِيهَا بِحَمِيدِ رَأْيٍ، فَإِنْ أَصَبْتُ فَاللهُ وَفَّقَنِي، وَإِنْ أَخْطَأْتُ فَالْخَطَأُ مِنْ قِبَلِي: أَرَى لَهَا مِثْلَ صَدَاقِ نِسَائِهَا، لَا وَكْسَ وَلَا شَطَطَ، وَلَهَا الْمِيرَاثُ، وَعَلَيْهَا الْعِدَّةُ. فَقَالَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ: " هُوَ يَشْهَدُ عَلَى النَّبِيِّ ﷺ أَنَّهُ سَمِعَهُ قَضَى بِالَّذِي قَضَيْتَ بِهِ فِي امْرَأَةٍ مِنْهُمْ، يُقَالُ لَهَا: بَرْوَعُ بِنْتُ وَاشِقٍ

✧ Ibn Mas'ud was asked, and it was said to him: "A man married a woman but did not specify a dower for her, and he died before consummating the marriage." He said: "I have not heard anything about this matter. Come back to me so I can look into it." They returned, then came back to him. He said: "I will give my considered opinion about it. If I am correct, it is Allah who guided me; if I err, the error is from me. I think she should have a dower like that of her peers, with no reduction or excess, and she inherits, and she must observe the waiting period." Ma'qil b. Sinan al-Ashja'i said: "He testifies that he heard the Prophet ﷺ rule exactly as you have ruled in the case of a woman of theirs called Barwa' bt. Washiq."
