حَدَّثَنَا أَبُو الْحَسَنِ مُحَمَّدُ بْنُ الْحُسَيْنِ الْعَلَوِيُّ إِمْلَاءً، أنا عُبَيْدُ اللهِ بْنُ إِبْرَاهِيمَ بْنُ بَالَوَيْهِ الْمُزَكِيُّ، ح، وَأَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، أنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحُسَيْنِ الْقَطَّانُ، قَالَا: ثنا أَحْمَدُ بْنُ يُوسُفَ السُّلَمِيُّ، ثنا عَبْدُ الرَّزَّاقِ، ثنا مَعْمَرٌ، عَنْ هَمَّامِ بْنِ مُنَبِّهٍ،
قَالَ: هَذَا مَا ثنا أَبُو هُرَيْرَةَ، قَالَ: قَالَ رَسُولُ اللهِ ﷺ: " اشْتَرَى رَجُلٌ مِنْ رَجُلٍ عَقَارًا، فَوَجَدَ الرَّجُلُ الَّذِي اشْتَرَى الْعَقَارَ فِي عَقَارِهِ جَرَّةً فِيهَا ذَهَبٌ، فَقَالَ لِلْبَائِعِ: - وَفِي رِوَايَةِ الْفَقِيهِ - فَقَالَ لَهُ الَّذِي اشْتَرَى الْعَقَارَ: خُذْ ذَهَبَكَ مِنِّي، أَنَا اشْتَرَيْتُ مِنْكَ الْأَرْضَ وَلَمْ أَبْتَعِ مِنْكَ الذَّهَبَ، وَقَالَ الَّذِي شَرَى الْأَرْضَ: إِنَّمَا بِعْتُكَ الْأَرْضَ وَمَا فِيهَا، فَتَحَاكَمَا إِلَى رَجُلٍ فَقَالَ الَّذِي تَحَاكَمَا إِلَيْهِ: أَلَكُمَا وَلَدٌ؟ فَقَالَ أَحَدُهُمَا: لِي غُلَامٌ، وَقَالَ الْآخَرُ: لِي جَارِيَةٌ، قَالَ: فَأَنْكِحُوا الْغُلَامَ الْجَارِيَةَ، وَأَنْفِقُوا عَلَى أَنْفُسِكُمْ مِنْهُ وَتَصَدَّقُوا ".

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنْ إِسْحَاقَ. وَرَوَاهُ مُسْلِمٌ، عَنْ مُحَمَّدِ بْنِ رَافِعٍ، كِلَاهُمَا عَنْ عَبْدِ الرَّزَّاقِ، وَالْقَصْدُ مِنَ الْحَدِيثِ بَيَانُ أَمَانَتِهِمَا وَتَرْكِ ادِّعَاءِ مَا لَيْسَ لَهُمَا، ثُمَّ فِي شَرِيعَتِنَا يَرْجِعُ إِلَى مَنْ مُلِكَتِ الدَّارُ عَنْهُ أَبَدًا حَتَّى يَظْهَرَ مَالِكُهَا
