✧ Prohibition of killing the offspring of idolaters.

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ يَزِيدَ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ إِسْمَاعِيلَ وَهُوَ ابْنُ أُمَيَّةَ عَنْ سَعِيدٍ عَنْ يَزِيدَ قَالَ كَتَبَ نَجْدَةُ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ قَتْلِ الْوِلْدَانِ وَعَنْ ذِي الْقُرْبَى وَعَنِ الْيَتِيمِ مَتَى يَنْقَضِي يُتْمُهُ وَعَنِ الْعَبْدِ وَالْمَرْأَةِ يَحْضُرَانِ الْفَتْحَ هَلْ لَهُمَا فِيهِ نَصِيبٌ فَقَالَ ابْنُ عَبَّاسٍ لَوْلَا

أَنْ يَقَعَ فِي أُحْمُوقَةٍ مَا أَجَبْتُهُ اكْتُبْ يَا يَزِيدُ كَتَبْتَ تَسْأَلُنِي عَنِ الْوِلْدَانِ إِنَّ رَسُولَ اللهِ ﷺ لَمْ يَقْتُلْهُمْ فَلَا تَقْتُلْهُمْ إِلَّا أَنْ تَكُونَ تَعْلَمُ مِنْهُمْ مَا عَلِمَ صَاحِبُ مُوسَى وَأَمَّا ذَوُو الْقُرْبَى فَإِنَّا نَزْعُمُ أَنَا نَحْنُ هُمْ وَأَبَى ذَلِكَ عَلَيْنَا قَوْمُنَا وَأَمَّا الْيَتِيمُ يَنْقَضِي يُتْمُهُ إِذَا آنَسَ مِنْهُ رِشْدًا وَأَمَّا الْعَبْدُ وَالْمَرْأَةُ فَلَيْسَ لَهُمَا شَيْءٌ

✧ That he should fall into foolishness? I did not answer him. Write, O Yazid: You wrote asking me about the children. Indeed, the Messenger of Allah ﷺ did not kill them, so do not kill them unless you know from them what the companion of Moses knew. As for the near relatives, we claim that we are they, but our people refused that to us. As for the orphan, his orphanhood ends when sound judgment is perceived in him. As for the slave and the woman, they have no share.
