أَخْبَرَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا ابْنُ عُلَيَّةَ عَنْ يُونُسَ عَنِ الْحَسَنِ عَنْ سَلَمَةَ بْنِ الْمُحَبَّقِ
أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ عَلَيْهَا فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لَهَا مَثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَعَلَيْهِ مَثْلُهَا لَهَا»

✧ A man went out on a military expedition with his wife's slave girl, and he had intercourse with her. That was mentioned to the Prophet ﷺ, and he said: "If he forced her, she is free, and he owes her mistress the like of her; and if she willingly followed him, she is a slave, and he owes her mistress the like of her."
